These terms and conditions (the "Terms and Conditions") govern the use of www.stinkybeasties.co.uk (the "Site"). This Site is owned and operated by Leanne Roger. This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Leanne Roger and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Accounts
When you create an account on our Site, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
- All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site.

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.
These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Payments
We accept the following payment methods on our Site:
- PayPal.
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:
- Royal Mail.
Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and bank holidays.
You will be required to pay delivery charges in addition to the price for the goods you purchase.
If you purchase goods from us for delivery to a destination outside the United Kingdom your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Right to Cancel and Receive Reimbursement
If you are a customer living in the United Kingdom or the European Union you have the right to cancel your contract to purchase goods from us within 14 days without giving notice. The cancellation period:
- Will end 14 days from when you receive, or someone you nominate receives, the goods when you purchased good(s) in one order that are all delivered together;
- Will end 14 days from when you receive, or someone you nominate receives, the last good when you purchased goods in one order that are delivered separately; or
- Will end 14 days from when you receive, or someone you nominate receives, the first good when you purchased goods that will be regularly delivered during a defined period of time.
To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at customerservice@stinkybeasties.co.uk.
The right to cancel does not apply to:
- Goods or services, other than the supply of water, gas, electricity, or district heating, where the price depends upon fluctuations in the financial market that we cannot control and that may occur during the cancellation period;
- Custom or personalised goods;
- Goods that will deteriorate or expire rapidly;
- Alcoholic beverages where the price has been agreed upon at the time of purchase, delivery of them can only take place after 30 days, and their value is dependent on fluctuations in the market that we cannot control; and
- Newspapers, magazines, or periodicals, except for subscriptions to such publications.
Effects of Cancellation
If you cancel your contract with us and goods have already been sent to you, then you must return the goods to us as soon as possible after informing us of your decision to cancel. You will be responsible for the cost of returning the goods. We will not be responsible for any damage or loss to the goods that occurs before they are returned to us, including while the goods are in transit.
If you cancel your contract with us, we will reimburse to you all payments we received from you under the contract, including the costs of delivery, except for any supplementary delivery charges resulting from your choice of a delivery type other than the least expensive type of standard delivery that we offer. Please note that we are permitted by law to reduce your reimbursement to reflect any reduction in the value of the goods that was caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
We will provide the reimbursement without undue delay and no later than the earlier of 14 days after we receive back from you any goods supplied or 14 days after you provide proof that you have returned the goods. If no goods were supplied, then we will provide the reimbursement no later than 14 days after the day we were informed of your decision to cancel.
We will make the reimbursement using the same form of payment as you used for the initial purchase unless you have expressly agreed otherwise. You will not incur any fees because of the reimbursement.
This right to cancel and to reimbursement is not affected by any return or refund policy we may have.

Refund requests must be made within 14 days after receipt of your goods.

Returns can be made by mail. To return a good by mail, follow the following procedure:
Please contact customer service for assistance. Products must be packaged correctly and sent back at the buyer's expense unless Stinky Beasties are at fault i.e wrong item sent.
Consumer Protection Law
Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Leanne Roger and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Leanne Roger and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the Country of Scotland.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Stinky Beasties: Nature's Pet Products is committed to complying with the latest rules and regulations regarding customer privacy and data protection. This document has been created in order to ensure Stinky Beasties: Nature's Pet Products compliance with the General Data Protection Regulation (GDPR) May 2018, and to provide continued transparency to customers of Stinky Beasties: Nature's Pet Products in regards to the use and safe storage of personal data. Any use of 'us', 'our' and 'we' in this notice refers to Stinky Beasties: Nature's Pet Products directly. Use of terms such as 'individuals', 'customers' or 'clients' refers to any person/s who have provided personal information to Stinky Beasties: Nature's Pet Products.
How We use Personal Information.
In order for Stinky Beasties: Nature's Pet Products to provide accurate quotations, the delivery of goods and online invoices, individuals must provide personal information (name, address, email etc.). There is no obligation from the customer to provide this personal information, however, with the exception of face-to-face sales, Stinky Beasties: Nature's Pet Products would be unable to provide it's services without this information. Customers maintain the right to object to the use of their personal information by Stinky Beasties: Nature's Pet Products. An individual may contact Stinky Beasties: Nature's Pet Products at any time during or post a transaction to request Stinky Beasties: Nature's Pet Products cease using their personal information, at which point, Stinky Beasties: Nature's Pet Products will A.) immediately cease all use of the personal information and dispose of any and all sensitive materials in an appropriate manner B.) provide a full and detailed explanation as to why, at that time, Stinky Beasties: Nature's Pet Products is unable to cease use of personal information. Stinky Beasties: Nature's Pet Products offers a postal delivery service with all orders at an additional fee to the customer. Royal Mail PLC is used as a third party company to fulfil the postage orders from Stinky Beasties: Nature's Pet Products, thus Stinky Beasties: Nature's Pet Products must provide Royal Mail PLC with certain details of a client's personal information (name, address). The use of Royal Mail PLC is made clear to the customer prior to any order and they must consent to the personal information being passed on from Stinky Beasties: Nature's Pet Products to Royal Mail PLC in order to complete a transaction with Stinky Beasties: Nature's Pet Products. LKR Woodcrafts operates with a focus on online sales. Etsy Inc., Facebook Inc. Microsoft Corporation and Twitter are all companies that provide online platforms in which a customer may contact Stinky Beasties: Nature's Pet Products. Should a customer contact Stinky Beasties: Nature's Pet Products using one of these methods, Stinky Beasties: Nature's Pet Products may request that personal information be sent via the platform in order to complete an order/quotation. The customer may choose to use one of these methods in order to provide the required information to Stinky Beasties: Nature's Pet Products, doing so gives consent for both Stinky Beasties: Nature's Pet Products and the chosen platform, unless otherwise stated in their own terms and conditions, to view and/or use the information provided. Using one of the mentioned companies to which Stinky Beasties: Nature's Pet Products has an online presence to contact Stinky Beasties: Nature's Pet Products opens a dialogue in which the customer gives consent to receive private messages within use of the given platform. All conversations between Stinky Beasties: Nature's Pet Products and the customer that may involve the use of personal information are done so in private. None of the information provided in these private messages will ever be shared publicly or with a third party, excluding government intervention (e.g. at the request of the police). Stinky Beasties: Nature's Pet Products may, on occasion, request that the customer provide pictures and/or feedback in regards to a completed order. Stinky Beasties: Nature's Pet Products will disclose any and all use for this material prior to the customer providing the information. Compliance to this request is optional on the part of the customer. Stinky Beasties: Nature's Pet Products provides a service in which a customer can personalise an item. This may lead to a customer providing the personal information of another party e.g. for a gift. Stinky Beasties: Nature's Pet Products will only contact the individual who initiates a transaction and/or provides payment for that particular order. It is the responsibility of the customer to ensure that they have received consent before providing another's personal information to Stinky Beasties: Nature's Pet Products.
The Personal Information We Collect & Safe Storage of This Information.
As mentioned in the previous section, Stinky Beasties: Nature's Pet Products must collect certain pieces of personal information from a customer in order to provide their services. This information will include the customer's name and address and/or the customer's email address and contact number. Paper copies of this information are stored in folders that are kept in a secure property and, within the property, an independently locked room. Digital copies of this information are stored on a password protected laptop used by Stinky Beasties: Nature's Pet Products. Any digital folder/document containing potentially sensitive information will have further encryption in order to keep the information secure. All passwords protecting private information differ and only the Director of Stinky Beasties: Nature's Pet Products is informed as to the passwords. Typically, Stinky Beasties: Nature's Pet Products will hold personal information of the customer for three years in order to fulfil repeat orders, track prior transactions and keep record of sales. After this time, Stinky Beasties: Nature's Pet Products will permanently destroy any personal information stored. In the case of paper copies, this information is shredded and separated and recycled at different times. In the case of digital files/documents, these are moved from the secure area of the computer to the recycle bin, where they are then permanently deleted from the computer system. Should an individual request that their personal information be destroyed before this time, Stinky Beasties: Nature's Pet Products will A.) Destroy the personal information thoroughly B.) give a detailed explanation as to why, at that time, Stinky Beasties: Nature's Pet Products is unable to destroy the information. Stinky Beasties: Nature's Pet Products collects any and all of the personal information directly from the customer. Sending Stinky Beasties: Nature's Pet Products this information shows direct consent from the customer that the information can be used and stored in the manner explained in the above information. Stinky Beasties: Nature's Pet Products does not collect outside information or information from third parties nor does Stinky Beasties: Nature's Pet Products send any personal information to third party companies without the consent of the customer (e.g. Royal Mail PLC). Stinky Beasties: Nature's Pet Products may receive personal information from PayPal Holdings Inc. This information is needed to complete payment and to deliver the goods ordered. A customer gives consent for Stinky Beasties: Nature's Pet Products to view and/or use this information when sending payment. The same is applicable for Etsy Inc.

Stinky Beasties: Nature's Pet Products is committed to protecting the personal information of its customers. To this end, Stinky Beasties: Nature's Pet Products will only use third party companies that adhere to the rules and regulations of Government Standards in regards to securing personal information. Any person/s whose personal information Stinky Beasties: Nature's Pet Products holds maintains the right to object to its use. Stinky Beasties: Nature's Pet Products will, as mentioned, cease use of the personal information immediately or, alternatively, provide a detailed explanation as to why this is not possible. Customers also maintain the right to view the personal information gathered by Stinky Beasties: Nature's Pet Products. Should this request occur, Stinky Beasties: Nature's Pet Products will provide any and all information regarding that particular customer, however Stinky Beasties: Nature's Pet Products will not provide anyone but the customer who has either contacted Stinky Beasties: Nature's Pet Products or the individual who made payment with information regarding that order, with the exemption of a Government Agency (e.g. Police). Customers may contact Stinky Beasties: Nature's Pet Products to update or correct contact details to which Stinky Beasties: Nature's Pet Products will oblige. Verification of identity may be required in this instance. Customers maintain the right to complain regarding the order or service received by Stinky Beasties: Nature's Pet Products. Stinky Beasties: Nature's Pet Products can be reached by means of the original method of contact prior to an order and will work to resolve any issue that arises. However, should a customer wish to make a complaint with the Information Commissioner's Office (ICO) they are entitled to do so. It may be necessary to amend and/or update this notice. Should the need arise, an updated version of this notice will be provided by Stinky Beasties: Nature's Pet Products.
